TERMS OF SERVICE

Newton’s Head is a Peddling Through, LLC Company.

This terms of service agreement is between Peddling Through, LLC (Newton’s Head) and the site users.

All brands, copyrights, logos, likenesses and registered trademarks are property of their respective companies or organizations. Peddling Through, LLC is not endorsed, sponsored by or affiliated with any companies or organization mentioned on www.NewtonsHead.com, unless otherwise stated.

Because electronic technology is constantly being innovated, depreciation of existing electronics is an unending variable. Therefore, if Peddling Through, LLC does not receive your order within ten (10) days of the quote date, the item will be subject to current pricing on the day it is processed.

If Peddling Through, LLC discovers that your products condition is different than described, we will generate a new price based on our diagnosis of the product condition. If the new price is within fifty dollars ($50) or thirty percent (30%) of what you were originally quoted, Peddling Through, LLC will adjust the amount owed to you and issue payment. If the difference is greater than fifty dollars ($50) or thirty percent (30%), we will give you the option to sell the product(s) for the new price, otherwise, we will return the card(s).  From the time Newton’s Head e-mails you with your new price, you have twenty-four (24) hours to reply and let us know if you would like to sell the product(s) or if you would like us to return the product(s). If you do not respond within the twenty-four (24) hour window, the order will be processed, a payment will be issued to you for the new amount, and the product(s) will be beyond return.

There is occasional confusion based on the model and/or generation of the product being sold. For instance, a customer may accidentally select that they have a 2nd generation iPod Touch when in fact it is a 1st Generation iPod Touch. In this case, Peddling Through, LLC will adjust the amount owed; issue an explanation and payment. If you have any questions about identifying what model and/or generation of a certain product you have, please contact us.

Peddling Through, LLC will issue payment via paypal or check within 24 hours of receiving your item. This 24 hour time frame is only active during business days. For instance, If Newton’s Head receives your item on a Friday, expect payment to be in route by the following Monday. Paypal & GiftCardCastle.com payments will show up in your account immediately, while checks can take 3-10 days for delivery.

Returns are only issued if Peddling Through, LLC adjusts the condition of your item and it affects the price as mentioned in “Pricing Subject to Change”. Under no other circumstances will returns be issued.

By submitting your product(s) to Peddling Through, LLC you are representing that you are at least 18 years of age and that you are the outright owner of the product(s). Fake or counterfeit items will be turned over to federal authorities upon receipt. We will easily identify fake and counterfeit items, we do not pay you for them and we do send them back to you. If you are not sure if your item is real or fake, please contact us.

All shipping labels have a inique order number on them, which we keep track of orders with. If you choose not to use our prepaid mailing label, we require that you print an invoice and put it in the parcel so that we can properly identify your order. If an item arrives without any information that tells us who it belongs to, the item will be re-priced the day of arrival and we will do our best to match it up with the correct party. If no party comes forward or the merchandise lacks adequate evidence to prove whom it belongs to, after 30 days the issue will be dropped and no one will be paid. We do not want this to happen, so please follow all directions so that we can properly identify your item upon arrival.

Peddling Through, LLC reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer. Verification of provided information may be required prior to the acceptance of any order.

Peddling Through, LLC is not responsible for any parcels that are lost or stolen in the shipping process. The items that our customers ship to us become our responsibility only when they arrive in our possession, prior to that you are responsible for them.

By visiting www.NewtonsHead.com, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern these Terms and Condition and any dispute of any sort that might arise between you and Peddling Through, LLC.

Prior to litigating any dispute arising out of this agreement, customers agree to mediate any disputes through Austin – Better Business Bureau. However, Peddling Through, LLC strongly recommends that you contact us prior to filling any disputes.

Privacy Policy

A privacy policy tells visitors about the types of information a website collects, how the site handles the information, and whether the site gives the information to anyone else. The Rule requires that the privacy policy be clear and understandable. The policy must give a complete description of the site’s information practices; it must not contain confusing or contradictory information.

NewtonsHead respects its users personal privacy. We do not share, sell, rent or trade user information. The information that we collect is used solely by NewtonsHead.

When registering, we collect our users…

We use this information to execute transactions.

We use non-identifying and aggregate information to better design our website and to share with advertisers. For example, we may tell our advertisers that X number of site users sold their iphones during the month of January, but we would not disclose any information that could be used to identify who those particular site users are.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronics, and managerial procedures to safeguard and secure the information we collect.

We completely wipe all of the information that is stored on our users electronic devices as soon as they’re received.

Newton’s Head, may use “cookies” to improve our level of service to users. Cookies are lines of text that are transmitted to your web browser when you click on a site. Your browser stores the information on your hard drive and when you return to the site later, the cookie is transmitted back to the server that originally sent it to you.

Cookies provide a way for a server to recall a pervious request or previous registration, or to keep track of a transaction as it progresses, so that information does not have to be repeated. To be notified when you’re about to receive a cookie you can configure your browser to alert you and at that time you will have the option of refusing the cookie. You can check your hard drive for cookie files, under “magic cookies” on Apples and under the “cookies.txt” file on PC’s.

Google, as a third party vendor, uses cookies to serve ads on your site. Google’s use of the DART enables it to serve ad to your users based on their visit to your sites and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google advertising privacy policies.

We are in compliance with COPPA (Childrens Online Privacy Protection Act). Newton’s Head is directed to people 13 years old or older.

By using Newton’s Head, you accept the conditions of our privacy policy.

All revisions to our privacy policy will be made without notice to this page. When such revisions are made, the following modification date will be updated.
